We do our best to accurately display our products, including colors, designs, sizing, descriptions, materials, and other details.

However, colors and appearance may vary depending on your screen, device, manufacturing process, garment blank, or production batch.

Many SwingN9T products may be produced in limited quantities, made to order, customized, or produced through a production partner.

Product availability is not guaranteed.

We reserve the right to:

• Discontinue products at any time

• Limit quantities available for purchase

• Change product designs, materials, blanks, colors, or specifications when reasonably necessary

• Correct product information or pricing errors

If a material change affects an order you have already placed, we will handle the situation in accordance with applicable law.

3. Pricing

All prices displayed on the website are subject to change without notice.

The price charged for an order will generally be the price displayed at checkout when the order is submitted, except in cases of an obvious pricing or technical error.

Taxes, shipping fees, and other applicable charges may be added at checkout.

Discounts, promotions, free-shipping offers, ambassador codes, and other offers may have separate eligibility requirements.

Unless otherwise stated, promotions cannot be combined.

4. Orders

Submitting an order does not necessarily mean that we have accepted it.

We reserve the right to refuse, limit, or cancel an order when reasonably necessary, including situations involving:

Shipping and fulfillment times may vary depending on the product, order volume, production requirements, destination, carrier conditions, holidays, and other circumstances.

Any processing or delivery timeframe provided on the website is an estimate unless specifically stated otherwise.

Tracking information will be provided when available.

Once an order is transferred to a shipping carrier, transit times may be affected by circumstances outside SwingN9T’s control.

Nothing in these Terms limits any right you may have under applicable law if an order cannot be shipped within a promised or legally required timeframe.

Customers are responsible for providing a complete and accurate shipping address.

SwingN9T is not responsible for delays or delivery problems caused by incorrect information entered by the customer, although we will reasonably assist when possible.

7. Free Shipping Promotions

SwingN9T may offer free shipping when an order reaches a specified purchase amount.

The qualifying amount and other conditions will be shown on the website or during checkout.

Free-shipping thresholds and promotions may change from time to time.

Orders that fall below the qualifying amount after a cancellation, return, adjustment, or other change may no longer qualify for the promotion when permitted by law.

8. Returns, Exchanges & Refunds

Returns, exchanges, and refunds are governed by our separate Return & Refund Policy, which is incorporated into these Terms.

By purchasing from SwingN9T, you also agree to the Return & Refund Policy in effect at the time of your purchase, subject to any rights provided by applicable law.

Generally, eligible returns and exchanges must be requested within the timeframe stated in our Return & Refund Policy.

9. Personalized & Custom Products

Some SwingN9T products may be personalized, customized, or specifically produced based on selections made by the customer.

You are responsible for reviewing customization information before submitting your order, including:

• Numbers

• Text

• Spelling

• Colors

• Sizes

• Product selections

• Other custom options

Personalized or customized merchandise may not be eligible for standard returns or exchanges unless the item is defective, damaged, incorrect due to our error, or otherwise eligible under applicable law.

10. Order Cancellations

If you need to cancel an order, contact us as soon as possible.

Because we may begin production or fulfillment shortly after an order is submitted, we cannot guarantee that every cancellation request can be completed.

Orders that have already entered production, customization, fulfillment, or shipment may not be eligible for voluntary cancellation.

However, nothing in this section removes any cancellation or refund rights you may have under applicable consumer protection law.

11. Discount Codes & Promotions

Discount codes and promotional offers are provided subject to the rules associated with each promotion.

We may refuse or cancel the use of a promotional code when we reasonably determine that it has been:

• Shared or used improperly

• Obtained without authorization

• Exploited through a technical error

• Used in violation of an ambassador or affiliate program

• Used fraudulently

• Used contrary to the stated terms of the promotion

Discount codes have no cash value and cannot be exchanged for cash unless required by law.

We may modify or discontinue future promotions at any time.

12. SwingN9T Ambassador Program

Participation in the SwingN9T Brand Ambassador Program is subject to the rules and requirements displayed on the Ambassador Program page, Ambassador Dashboard, approval communications, and any additional program terms provided to participants.

The Ambassador Program is a commission-based affiliate program and is not employment or guaranteed paid sponsorship.

Participation does not create an employer-employee, partnership, joint venture, franchise, or agency relationship between SwingN9T and an ambassador.

Ambassadors are responsible for complying with applicable advertising, endorsement, tax, social media, and disclosure requirements.

Ambassadors must clearly disclose their relationship with SwingN9T when promoting products when required by law.

13. Ambassador Commissions & Discounts

Current ambassador discounts, customer-facing codes, commission percentages, and other program benefits are described through the Ambassador Program or Ambassador Dashboard.

Program benefits may be updated from time to time.

Commissions are earned only on qualifying completed sales.

SwingN9T may reverse, withhold, or remove commissions connected to:

• Refunded orders

• Returned orders

• Canceled orders

• Chargebacks

• Fraudulent transactions

• Self-referrals prohibited by program rules

• Abuse of discount codes

• Duplicate or manipulated transactions

• Transactions that otherwise do not qualify under the program

Ambassadors are responsible for any taxes associated with payments they receive.

Participation in the program does not guarantee free products, sponsorships, rodeo entry fees, travel reimbursement, gas money, paid partnerships, or any specific amount of income.

14. Ambassador Conduct

SwingN9T ambassadors are expected to represent the brand in a professional and lawful manner.

We reserve the right to suspend or remove someone from the Ambassador Program for conduct that we reasonably believe involves:

• Fraud or commission manipulation

• Harassment or threats

• False or misleading claims about SwingN9T

• Misrepresentation of the ambassador’s relationship with SwingN9T

• Unauthorized use of SwingN9T intellectual property

• Illegal activity connected to the program

• Repeated violation of program requirements

• Conduct that materially harms the brand or its customers

Any legitimately earned commissions will be handled according to applicable program rules and law.

15. Sponsorship Programs

SwingN9T may separately offer sponsorship, pro-team, creator, athlete, or other promotional programs.

Applying for or participating in the Ambassador Program does not guarantee sponsorship.

Sponsorship opportunities may have separate requirements, agreements, benefits, and eligibility standards.

16. Accounts

Some features may require you to create a customer or ambassador account.

You are responsible for maintaining the confidentiality of your login information and for activity conducted through your account.

You agree to provide accurate information when creating or maintaining an account.

Please contact us if you believe your account has been accessed without authorization.

We may suspend or terminate accounts used for fraud, abuse, unlawful activity, or material violations of these Terms.

17. Intellectual Property

Unless otherwise stated, the SwingN9T name, logos, artwork, graphics, product designs, photographs, website content, written content, videos, branding, and other materials are owned by or licensed to SwingN9T and are protected by applicable intellectual property laws.

Purchasing a SwingN9T product does not give you ownership of our trademarks, copyrighted material, artwork, or other intellectual property.

You may not reproduce, copy, manufacture, sell, distribute, modify, or commercially use SwingN9T intellectual property without prior written permission.

Approved ambassadors may use authorized brand materials solely for legitimate promotion of SwingN9T while participating in the program.

18. User Content

If you submit, send, tag, or provide us with reviews, photographs, videos, testimonials, comments, or other content, you remain responsible for that content.

If you specifically authorize SwingN9T to repost or use your content, you grant us permission to use it for the purposes agreed upon.

Submitting content does not give SwingN9T ownership of content that you do not own.

You represent that content you provide does not knowingly violate another person’s rights.

19. Reviews

Customer reviews must reflect genuine experiences.

You may not knowingly submit fraudulent reviews, impersonate another person, or use reviews to make unlawful, defamatory, or knowingly false claims.

We may remove reviews or other content when reasonably necessary to address spam, fraud, unlawful content, harassment, or violations of website rules.

We will not remove a legitimate negative review simply because it is negative.
